: I filed bankruptcy almost 6 years ago. Do to things beyond my control I am going to have to file again I think. How long do I have to wait until I file bankruptcy again. And I have a car that I cant afford payments on now . If I let this get repoed ( already behind 2 payments) and get sued over it can I include this in my bankruptcy?$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$
First, you have to wait for 7 years from the date of filing (I believe its the date of filing, not the date of discharge, but I could be wrong) your first bk (if it was a Chapt 7 and you want to do another Chapt 7) before you can file again. Meaning if you filed 8/1/96 you could file again around 8/2/03.
Second, if your car gets repoed and they sue you, yes you can include this in your bk, however, it sounds like you are at least a year from being able to file again. You are able to do a Chapt. 13 at any time though.
