You can file a BK7 every 6 yrs and a BK13 anytime you want to. If your are not quite to your 6yr anniversary you may want to file a chapter 13 to keep your car especially if you have income. You may be able to do a cram down on the car: It's best to seek an attorney's advice as to which is best for your situation.If you don't want the car they can repo it, sell it, and sue you for the deficiency balance. Do you own a home? If so they can file a lien against your home after they've sued and got a Default Judgment against you. Most liens survive bankruptcy. You can include it in your BK but the lien will survive and have to be dealt with at some future point.
I filed bankruptcy almost 6 years ago. Do to things beyond my control I am going to have to file again I think. How long do I have to wait until I file bankruptcy again. And I have a car that I cant afford payments on now . If I let this get repoed ( already behind 2 payments) and get sued over it can I include this in my bankruptcy?
