: Can I file bankruptcy against payroll taxes from 1994? My company is out of business, and I've been fighting with the IRS for 8 years about this matter. They've jerked me around since the beginning, making up arbitrary amounts that I owed. Everytime I discussed a payment plan and settlement, they handed it over to a new case worker. Basically, I've had it. Now they say I owe $64,000. The tax is actually paid now, this is interest and penalties. Can I go bankrupt against this? I do not own a house or have a car in my name (couldn't get any of that stuff since the IRS had a lien against me). They can't take anything from me, I don't have any assets.--------------------
The rules on getting out of taxes are pretty complicated and I don't get all of them, but in general, if the tax is over three years old, and you're current on all your tax forms (and didn't just mail them in), and you didn't commit fraud, there's a good chance. But I'd talk to a BK lawyer.
