You will have to file bankruptcy on your mom. However, if you still have minimal disposable income without including the $300 payment to your mom - you may be just fine.We borrowed from family and had made payments. We recorded it on our documentation. Our 7 was discharged without any problems.

: I live in Fl. My Husband and I are thinking of claiming bankruptcy (Chap. 7), we make 50K year. My unsecured debt is about 25K, and I have another 30K in School loans , which I know can't be discharged. With the high cost of daycare, I just cannot make ends meet. When I do my numbers, I have little or no disposable income. My only problem may be my car.I have a 2001 intrepid --the title is in my name, but I am paying my Mother in law back $300 /mo. She sold it to me for $8,000. I NEED my car. My husbands car is a piece of junk.. Since the title is my name, can I have her take a lien out on the car for what I owe her? Could that be a way to keep my car through bankrupcty? I really do owe her this money, and I really do pay her everymonth.. Any suggestion?
