What you experienced is not uncommon with other creditors either or mortgage companies. What a lot of folks don't realize until they pull their credit reports either during their BK or right afterwards, is that for debts paid outside the Plan (i.e., mortgage or car payments), you can find them listed by the creditor as "included in Chapter 7" or "included in Chapter 13" or however they happen to word it. That is true - the debts are part of your BK or Chapter 13 plan (they are listed on your Plan Order but you are required to pay them outside the Plan and the creditor was notified you are in BK) and that is how they are able eto word it that way and you may not be able to get it changed. It all depends on the creditor. If an account is included in your BK, they are required to take away any and all listings as to past due amounts and insert that the account is or was involved in BK. We were able to get our information changed as to our mortgage payments (both of which we paid outside the Plan and were never late). Again, it all depends on the creditor. Once in a while you run into a tough one as both of you apprently have. What you can do as to the car loan is send the creditor a copy of the section/order of the Chapter 13 showing that the car was paid outside the plan and remind them of the date of the last payment, that it was paid prior to the discharge ofo the 13. As to the credit card, they need to remove all the late information once that account is included in BK. I would consistently dispute that until the matter is resolved. As to the car insurance, if you have a car insurance carrier that does credit checks all the time or you have not been with them for a really long time, a lot of them will raise your rates since you are now considered a higher risk since you filed BK and might be more prone to file claims (how they determine that one, I don't know). It could occur with your house insurance also. What you have gone through is quite common. It will not be any better even if you try to switch carriers cause they will run a credit check also. I wish you luck in your situations...I know how frustrating this all can be and extremely time consuming.


: I am not the least surprised about USAA's reaction. We also had a creditcard with them as well as a car loan plus checking and savings account. The credit card was included in our Ch13, while we continued to pay the carloan OUTSIDE the Ch13. On advise of our attorney we opened a checking and savings account with a local bank prior to filing and had all paychecks go into that account.
: Our Ch13 was discharged over a year ago and when I pulled our credit reports I saw that USAA still reported the creditcard as past due with the full balance still open and the carloan showed 'discharged thru Ch13' which is incorect since the car was paid off less than a year into the Ch13. USAA, however, to this day refuses to correct the information on the credit reports stating that they took a loss and that is their way of handling it. We are now looking into possibly suing them!!!
: Also USAA has done a number on our car insurance. The car insurance jumped 32% this year - we have not had a claim, ticket or anything in over 10 years - and USAA said they somehow had to recover their loss.
: USAA used to be run by retired military people but over the years it changed to civilians who had never served at all. These people brought their 'philosophy' with them!!!
